If you are connected with an affiliated firm through this Site, any brokerage or professional relationship exists solely between you and that firm, under its own separate agreements.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). 13. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles, except to the extent superseded by the Federal Arbitration Act as described below.

14. Binding arbitration and class-action waiver

Except for claims that qualify for small-claims court and claims for injunctive relief regarding intellectual property, any dispute arising out of or relating to these Terms or the Site will be resolved by binding, individual arbitration administered under the commercial arbitration rules of a mutually agreeable arbitration provider, seated in Mecklenburg County, North Carolina, and governed by the Federal Arbitration Act. YOU AND DISCOVER ELIZABETH EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. The arbitrator, not any court, has exclusive authority to resolve disputes over the interpretation or enforceability of this arbitration provision, except that the class-action waiver's validity may be determined only by a court.

Opt-out. You may opt out of this arbitration provision by sending written notice to npeters@yourleaderinluxury.com within 30 days of first accessing the Site or of any amendment to this provision, whichever is later, stating your name and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Mecklenburg County, North Carolina, and both parties consent to the personal jurisdiction of those courts.

15. Severability

If any provision of these Terms is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Changes to these Terms

We may update these Terms from time to time. The "Effective & last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.
